3. User Accounts and Registration

To use DeterminedVision LLC's services, you may be required to register an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify DeterminedVision LLC immediately of any unauthorized use of your account. DeterminedVision LLC is not liable for any loss or damage arising from your failure to maintain account security.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Opt-In Method: To participate in DeterminedVision LLC's SMS program, you must provide explicit consent through a double opt-in process. This process involves: (1) filling out a web form with your mobile phone number and confirming your interest in receiving SMS messages; (2) receiving a confirmation SMS message; and (3) replying "YES" to the confirmation message to complete the opt-in process. You will only begin receiving program messages after completing all three steps.

Opt-Out and Help: To stop receiving SMS messages from DeterminedVision LLC at any time, reply "STOP" to any message. You will receive a confirmation that you have been unsubscribed. For questions or assistance regarding our SMS program, reply "HELP" to any message, or contact us using the information provided in Section 12 (Contact Information). Message and data rates may apply to these requests.

6. Intellectual Property

All content, materials, trademarks, logos, and intellectual property associated with DeterminedVision LLC's services are owned by or licensed to DeterminedVision LLC. You are granted a limited, non-exclusive, non-transferable license to use our services for their intended purpose. You may not reproduce, modify, distribute, transmit, or otherwise exploit any content without prior written permission from DeterminedVision LLC.

7. Limitation of Liability

To the fullest extent permitted by law, DeterminedVision LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of profits, data, or business interruption, even if DeterminedVision LLC has been advised of the possibility of such damages. You agree to indemnify and hold harmless DeterminedVision LLC, its officers, directors, employees, agents, and successors from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (1) your use of our services; (2) your violation of these Terms; (3) your violation of any law or regulation; or (4) any content or messages you send through our services.
